Q.812 Need passport - No birth certificate as birth at home . . . . .
Question: Dear sir ,
My query is i was born after 26th jan 1989..d.o.b is 05/09/1989...as u said in ur replies birth certificate is mandatory.
but my birth was done at home..nd that time our village people do not have any hospital facility..i want to apply for
passport..what is the solution please suggest something..

Answer: I can only quote what the government rules are. Those born on or after 26 January 1989 need to provide a
birth certificate when applying for Indian passport.
Under the provisions of the Births & Deaths Act,1969. In cases where birth occurred at home and not a hospital, the
head of the family or any other family member had the responsibility to notify the concerned authorities within 21
days and register birth accordingly.
For all you know, perhaps some family member may have even done so in your case!
I can offer some suggestions and you can decide how to proceed.
•
Apply for a birth certificate from your municipal office that is associated with the village you were born in.
•
When someone applies for a birth certificate from the appropriate municipal office in the area they were born, if
no record of birth registration is found then the municipal office will issue a letter stating that no record was
found in their records. This is usually referred to as ‘Record Non Availability’ certificate. A nominal fee may be
charged for this service. [Record Non-Availability is probably issued for just about any type of record an
applicant requests and the office does not find in their record files.]

Once you get this type of document you can approach court through a lawyer to get a birth certificate. Present
to the court all your documents such as:

Record Non-Availability Certificate
o
School certificate showing date of birth AND any other document that you may have such as:

Pan Card
▪
Driving License
▪
Voter registration card
▪
Any other document that would help confirm your date of birth

Once court verifies your documents they have the authority to order the appropriate authority to issue a birth
certificate.
o
Do keep in mind that the date of birth on your school record and the date of birth on other documents you
submit for verification to the court must all match.
o
Your best option is to speak to a lawyer and then decide how to proceed.
Information for NRI readers unable to get birth certificate
For NRIs who were born before 1969 when the registration rules came into effect. I believe Indian consulates do
issue Non-availability of birth certificate to those Indian citizens who were born in India before June 2, 1969. Check
with your nearest Indian consulate for more information on this type of document.
