Q617. OCI for spouse of foreign origin - New rules as of January 6, 2015

Question: I am an OCI and married to a Singaporean Indian whose both parents were born in Singapore and are citizens of Singapore. My spouse and his parents have never held any citizenship other than Singapore. One grandparent of my spouse is of Kerala origin and the other is of Ceylonese origin. Is my spouse eligible for OCI ?

Answer: New rules regarding who can apply for OCI came into effect from January 6, 2015. The new rules allow OCI to a foreign spouse under some conditions: The spouse of foreign origin of a citizen of India or spouse of foreign origin of an Overseas Citizen of India card holder registered under section 7A and whose marriage has been registered and subsisted for a continuous period of not less than two years immediately preceding the presentation of the application.
