Q1184. OCI holder acquiring agricultural land by gift from family member

Question: Hi, I am Canadian citizen and has OCI card.

My question is that Can my sister/mom give me agriculture land in India ? Can it be transferred on my name Can my sister give as gift ?

I was farmer before I became Canadian Citizen and I still have that land. Can I keep that land ?

Pl. answer me as it is very important for me.

Answer: 1. Your sister/mom can't give you agricultural land in India as a gift nor can they sell it to you as OCI holders cannot acquire agricultural land by way of gift. Hence it can't be transferred to your name in this manner.

  1. The land you already owned, is still yours to keep provided you acquired ownership of the land in a legal manner. You can, if you wish either sell or gift the land to your sister or mom provided they are citizens of India and residing in India.

  2. You can acquire agricultural land by way of inheritance only as foreign nationals of Indian origin can inherit and hold immovable property in India from a person who was resident in India. .
