Q.1169 How to get Power of Attorney from Indian Consulate after

becoming US citizen . . .

Question: Hi, I have to send my mother POA so she can sell the property in India that is in my name. I recently was sworn in as a US Citizen and now I am confused how I should get the POA made as before I got it done through the Indian consulate but now my Indian Passport is probably not valid and would the consulate still do that for me? Answer: You can still get POA attested at Indian consulate despite now having taken US Citizenship. To get any consular services once a person gives up Indian citizenship they must first show proof of having surrendered their Indian passports and renounced their Indian citizenship. If you have already done this, I doubt if you will have any problems of getting a Power of Attorney document attested at Indian consulates. Generally for those who have given up Indian citizenship and now become US citizens, the procedure to get a POA to be sent to India is: 1. Get a POA document prepared as per your requirement 2. Document should be Notarized by a Notary in USA 3. Indian consulates require attestation documents to be Apostilled before presenting them to the consulate for attestation. 4. Get attestation done at the Indian consulate applicable to your jurisdiction. A personal visit or through the post are options that are available. Remember those individuals who previously held Indian passports must show proof of renunciation of Indian citizenship to avail any consular services at Indian consulate.
