Q681. Indian student visa for Indian passport holder NRI living abroad

Question: Dear sir, My daughter (19 years of age) is on an Indian passport but is living in the UK for the last 7 years on indefinite leave (Visa) (UK qualifications) now she is planning to do her further studies in India. I the father is also on an Indian passport with the same status as my daughter. My question is: Is she an NRI? Does she need a provisional student visa to study in India? Does she need to obtain a clearance certificate from the ministry of health and family welfare? Thanks Colin Fernandes Answer: In my opinion, as long as your daughter has a legally valid Indian passport and has not renounced Indian citizenship, she continues to enjoy the benefits associated with Citizenship of India. When she leaves India to live abroad she is considered a NRI and when she returns to India to live, she becomes a resident Indian citizen. Visas are issued by countries not to their own citizens but to foreign passport holders. Indian passport holders do not need a student visa to study in India. You can alleviate your concerns by contacting the Indian consulate in UK and seek clarification.
