190. Owning agricultural land in India after acquiring foreign citizenship
Q: Hi Mr Chand,
I come from Maharashtra state and have been holding an agricultural land on my name as it is self acquired. as my father too has been a
farmer, this property is self acquired by me. i had purchased it before moving to Canada, It is not inherited from any of my parents. but soon
i shall be becoming a Canadian citizen, so am in doubt as to will i be still able to hold this self owned property in Maharashtra? Can you
please clarify this doubt!!!
Thanking you in Anticipation,
Sincerely,
Sachin
A. From what my understanding is, you can continue to hold agricultural land that you held prior to becoming a foreign
citizen. Property you legally owned before acquiring Canadian citizenship will still be legally yours until you decide to sell it.
If you decide to sell it in future, as per Reserve Bank of India guidelines you would have to sell it to a person who is resident
in India and also a citizen of India.
