209. How to get visa for new born child in India to foreign parents

Q: Dear Mr Chand, We would like to know how to apply OCI for a child whose mother is Indian born British Citizen. Mother has got a British Citizenship and OCI, who has given birth to a Child in India and has got Local Muncipal Birth Certificate. 1) Do we need to take OCI first or a British Passport . 2) If we take a British Passport first what will be the status of the child in this country without a Proper visa on his passport. 3) Can we apply OCI on the base of mothers passport or Mothers OCI. We appreciate your earlier reply Thanking you A K Sayani A. Congratulations! The process to get all this sorted out may sound complicated but is fairly simple. First, get a British passport for your child. Your child can't get a visa or OCI without having a valid passport. The Foreigner Regional Registration Offices (FRRO) normally issue visas and also extend visas in India. However to issue the first visa for a new born child, FRRO offices need authorization from the Ministry of Home Affairs. You need to contact the Ministry of Home Affairs, Foreign Division, Jaisalmer House, 26, Man Singh Road New Delhi. Basically, the ministry requires you to fill in the appropriate form, submit copies of passports of yourself, your wife and the new born child. If all is found in order, you will be given a sealed envelope to take to the FRRO office in your area. This envelope has the authorization letter from the ministry to the FRRO to issue a new visa. You would be required to pay the applicable visa fee also at the FRRO office. My understanding is that for a new born child you cannot apply for OCI unless you get a visa first. If you contact the nearest FRRO office you will be able to get all the information you require.
