292. Apply for Indian Citizenship - Proof on entry and legal stay in India required

Q: Hello Sir, Chetan here. I am basically from Gujarat and working in Pune now. I have issue regarding Indian Citizen ship of my mother,She born in Africa and she was having (UGANDA-British Passport). My Grand Parents having Indian Citizenship. Now i m applying for my mother's passport. And i need to submit copy of valid Indian VISA of my mother. The document of visa is missing and my mother was younger then 5 year when she came back to India. In short i m not able to apply for passport of mother as she don't have Indian Citizenship and I m not able to apply for her Indian Citizenship as she don't have valid Indian Visa document. Please help me out. Thanks & Regards, Chetan. A. While your mother certainly meets the residency requirement to apply for Indian citizenship, what you are missing proof of her being in the country legally. That is the reason a visa is being asked for. The authorities probably want proof that: 1. Your mother entered the country legally and 2. That she continued to stay in India legally. For example a person on a tourist visa for six months who simply continues to live in India once their visa has expired without making efforts to renew their visa are deemed to be in India illegally. Unless you can find some way to convince the authorities of the two points mentioned above it may be difficult to get Indian Citizenship. Perhaps a lawyer may help you sort this out by way of providing affidavits if your old documentation is lost.
