303. Apply for NRI Status

Q: Hello, I hope you can help me. My father was born in India in 1922 and his birth certificate shows he was born near Lucknow to a British soldier and British mother. Does the fact that he was born in India and lived there for many years allow me to apply for an NRI status? I understand that technically he is not Indian but the wording on the application form is a bit vague. Many Thanks, James Snelling A. Every person born in India on or after January 26, 1950, but before July 1, 1987 is a citizen of India by birth. The nationality of their parents in such cases does not matter. Too bad this does not apply in your case! I assume, when you say apply for 'NRI status' you mean applying for PIO card. If you have acceptable documentary proof of your father's birth in India, you could apply and let the Indian consulate officials decide.
