Questions: My Father in Law was born in India
but came to the UK in the 1950's where he took
on citizenship and gave up his Indian Passport. He
now is in his 70's and would like to live in India full
time in the property that he owns there.
Can he apply for Indian citizenship again and give
up his UK status?
Answer: Your farther in Law certainly has the
option to apply for Indian Citizenship.
Your father in Law has two options by which he
could live in India:
1.
Keep his UK citizenship, get OCI which is a
lifelong visa for India.
2.
The second option is what you mention, get
Indian Citizenship and give up his UK status.
Keeping his UK status will keep a door open for
him in case he needs to return to UK. Medical
facilities, benefits etc. should be taken into
account before deciding to give up British
Citizenship.
The fastest way to get Indian citizenship is to
apply under section 5(1)(f) of the citizenship act,
1955. The eligibility for applying is:
A person of full age* and capacity who, or either
of his parents, was earlier citizen of Independent
India, and has been residing in India for one year
immediately before making an application for
registration.
(* Full age means 18 years of age.)
