Q.892 USA citizen with OCI admission in Medical college under NRI quota

My daughter is USA Citizen by birth, holding USA PAssport with OCI Card and stydied in India for 6 years. Now we are planning to apply for her MBBS under NRI Quota or FN quota, but colleges are telling their own definition. Few are saying she come under FN, few are saying NRI and few are telling that as she studied in India, she would not be onsidred NRI. I am also USA Ciizen and filing my taxes in USA Ever year and filing state tax as resident of USA and no income in India. I went to Indian consulate in USA, and they are telling NRI definition only applies to Indian Citizen and as my daughter is OCI Card holder, she would be considered as NRI only but there is no such certification they are giving as such. Please suggest how to get validate NRI status so her college admission can continue under NRI or FN quota ? Although foreign nationals of Indian origin are generally also referred to as NRIs they are legally classified as persons of Indian origin (PIO). An OCI holder is technically not an NRI but a person of Indian origin granted a lifetime Indian visa and some specified benefits. As far as admissions in India to medical colleges for OCI holders, there seems to be no set criteria and just about every state has different set of rules. The state of Kerala for instance considers PIO & OCI holders to be equivalent to Indian nationals when it comes to medical or engineering college admissions in Kerala. Here is an excerpt from the Kerala office of the commissioner for entrance examinations: 2. Eligibility for Admission: I. Nativity: Applicant should be an Indian citizen. Persons of Indian Origin (PIO)/Overseas Citizen of India (OCI) Card Holders will be treated on par with Indian citizens for the limited purpose of admission.
