Q.941 OCI eligibility for foreign spouse & child of Indian citizen
Question: Dear Sir/Madam,
Namaste....
I would like to enquire about to apply OCI for my wife & daughter,
Am Vigneshwar Nagaraj (Indian) i married a Philippine nationality and i have a baby 25 months old (Wife & Baby
holding Philippine passport) . In august i bring both of them to india in 05 years multiple entry visa, now they are
staying in india with my family.
I had registered in FRRO office in local town for my wife & baby, i have the certificate for both of them.
They arrived india on August,2016. Staying in Tirupur , Tamilnadu - India.
Can i apply OCI for both of them??
What is the procedure & document required??
KIndly guide me for the same.

Answer: Under new rules a foreign spouse of an Indian citizen can apply for OCI.
New rules on OCI registration allow OCI to a spouse of foreign origin of a citizen of India or spouse of foreign origin
of an Overseas Citizen of India card holder registered under section 7A and whose marriage has been registered and
subsisted for a continuous period of not less than two years immediately preceding the presentation of the
application under this section; provided that for the eligibility for registration as Overseas Citizen of India card holder,
such spouse shall be subjected to prior security clearance from a competent authority in India.
