Q.949 Recommend lawyer in Gujarat for US citizen selling property

Question: Hello, My parents wish to sell their real estate holdings in Gujrat, India. They live in the US, are US citizens, and are looking for reliable legal representation. How would you recommend that we find someone? I’m assuming a real estate attorney is the way to go. Anup Patel, Answer: It may come as a surprise to you but generally when selling property in India the purchaser of the property is the one who requires a lawyer and the seller usually does not need one or don’t bother to get one. The buyer needs a lawyer to check ownership of the property and various property records to confirm that the party selling the property is indeed the owner and that all documentation is in order. The seller on the other hand receives the money and signs the dotted line in the registration office. Non-residents would need the service of a chartered account who can give sound financial advise to save tax and help with the repatriation of the sale proceeds of property. I cannot recommend a lawyer in Gujarat as I make it a point to not recommend any professional or service until I have dealt with them. Check with friends or family in Gujarat to see if they can recommend someone. The Internet is another good source. All said and done, quite frankly its not easy to find a reliable, honest and trust worthy lawyer in India easily. So you will have to do your own research and go with the one you feel comfortable dealing with.
