Q.1017 Registration at FRRO of USA minor children staying over 180

days

Question: Sir, I am Humera Makwana, moved to Mumbai, India in August 2016 from USA. I have two kids one 5years old and one 8months old. They both are holding American passport. Right now they are on 1 year multiple visa. But we just noticed it say's on the visa if we are staying over 180 days we need to register which we didn't do it. But in December 16 2016, I went to U.A.E with my kids and came back on 5th January. (whichmeans i left the country before 180 days). Now we are in the process of collecting documents for OCI beacuse we are planning to stay here for few years. So my question is, since we have not done registration for my kids can we still get the OCI. or what would be my next step. Please guide me because I am little confused. I don't want my kids immigartion status to go bad. Thank you Humera Makwana. Answer: I actually just received your email and am responding because I don’t want you to worry. If it is the registration of your five year old and eight month old kids that you are concerned about, then you may not worry. My understanding is that minor children are exempt from registration as per paragraph 2 of Registration of Foreigners (Exemption) Order, 1957. A copy is attached HERE. Am positing a link to a page from MHA website that you can refer to. http://mha1.nic.in/pdfs/ForeigD-FRRO_version223.6.11.pdf Scroll down to ‘c’ and you will see ….” No registration is required in respect of children below the age of 16 years” I am not sure what is stamped on your visa, whether it is something specific or a general guideline that is stamped on all long term visas, advising the visa holder that registration is required if intention is to stay over 180 days in India. You can visit the FRRO office near you and get this clarified.
