Q.1085 Power of Attorney from mother in USA to Son who is OCI holder

I have a question regarding POA.
Is it mandatory to give POA to person who residing in India?
MY mother(live in USA) can give POA to me,also OCI holder?

Answer: There is no rule that says Power of Attorney must be given to only someone residing in India. POA can be given
to anyone regardless of whether they are in India or abroad.
The only restriction when giving a Power of Attorney [POA] to someone is, that the person giving and the person receiving
the POA must be of major age and competent. The reason for which the POA is given should also be legal.
Your mother living in the United States can give you POA to act on her behalf. If POA involves property matters then
attestation of POA at Indian consulate and registration of POA in India will be required.
