Q.1237 Power of Attorney from Australia to transfer property in India

Question: Hello sir I'm residing at Sydney for the past 2 years. I'm having a share in my grandmother's property. Now I want my father to take the possession of the same. How can I generate the power of attorney from Sydney for property in India. Thanks Answer: You can get a Power of Attorney document made and then get it attested at the Indian Consulate. This previously required visiting the Indian consulate but these days the Indian Consulate in Australia has outsourced services such attestation of documents to VFS Global. Those seeking attestation of documents should contact the VFS Global. Prepare Power of Attorney required in India from Australia

Basically you need to do is: 1. Get the power of attorney document prepared specifying what you are issuing the power of attorney for. You can do this yourself but it is advisable to consult an attorney especially when preparing POA for property related matters. 2. Once the POA is prepared you will need to get Apostille stamp. See the Apostille information link posted above. 3. Submit to VFS Global for attestation. This procedure and fee required is posted on VFS Global website. Power of Attorney document prepared abroad for sending to India does not require a Stamp paper and can be prepared on a plain white paper. For more detailed information on preparing POA from abroad see article titled Executing a Power of Attorney from Abroad to send to India’ >> Note: Once a document is Apostilled there should actually be no need to get the document also attested at the Indian Consulate. However, the seal of the Indian consulate stamped on a document sent to India from abroad is easily recognizable and does add to its authenticity in the eyes of some officials.
