I am an Indian national planning to marry a foreign girl. But she has a baby of 3years old from her ex boyfriend. I know that she

can get PIO after 1 year of marriage. Is it possible to get a PIO or visa easily for the baby too to visit India or to live in India.

I do not find any information regarding this in any forum. I am concerned about this because presently I am living in Europe, but

would move back to India at later point of time.

Answer: Some countries have strict rules on allowing one parent of a minor child, where parents are divorced or separated to take the child out of the country. Proof of the real father’s consent to allow the child to be taken abroad will be required before the Indian consulate will issue a tourist visa for such a child. So your wife will have to approach her ex-boyfriend to sort this aspect out. If your wife has any documentation showing sole custody of the child, it probably will help. However, her ex-boyfriends permission will still be required by consulate visa officials in an acceptable format, showing his consent to allow the child to be taken abroad. A tourist visa would be the easier route, once you have the documentary proof of relationship and no objection of the father to take the child out of the country. In case at a later stage you wish to get a PIO card for the child, you may have to consider legal adoption of the child. The Indian consular officials in your area of residence should be able to guide you, as to what documents are required. Keep in mind, that even after a visa is issued, proof of the other parents consent may even be required by authorities at the time of departure in some countries.
