Q541. US born baby traveling to India with Indian passport does not need visa
Question: Hi Mr. chand, I am an Indian citizen in California (USA) on L1 visa with my wife (L2 visa). But my baby was born here
(U.S), two months back. We are planning a one month trip to India this summer . Please give me your expertize advise for the
following questions.

1) We do not want to settle in USA and will move to India permanently in upcoming 2 - 3years. So, for the India trip, my baby needs
Indian passport with POI card. Is it correct ?
2) After the trip, when we will be heading back to California (USA), Will my baby needs USA - VISA as she is having Indian passport ?
3) If my baby needs visa, will I or my IT company have to apply for it ?
4) If she doesn't need visa, then what should be my move at the Indian International airport during departure and at the America
port of entry during arrival after the trip ?
5) Will her birth certificate and social security number would be enough to prove her American citizenship at the USA port of entry?

Answer: Your questions are already answered in response to a similar question. See answer to question number 520.
Regarding your five questions:
1.
Your baby will not need a PIO card if you opt for a Indian passport. Those who travel to India on the basis of an Indian passport
do not need a visa to enter India. In case you decide to get a American passport for your baby, then a visa to enter India will be
required.
2.
If you opt for an Indian passport for your baby, your baby will not be able to get a US visa in India as she will in reality be a US
born citizen by birth. Your baby will require a US passport to return to USA
3.
Your baby will definitely need some travel document to return to the US. Check with your company before you leave as to what
help they provide.
4.
With an Indian passport and no US visa, your baby will not be allowed to leave India.
5.
Birth certificate may be enough to prove American citizenship but to travel in and out of USA a passport is required.
