Q568. Do I need to be present to receive items sent on Transfer of Residence

Question: Got this address from the webpage NRI Information. My question: I plan to send used content (books, used clothes, curios, used kitchen utensils) that are personal items I have used over the 15 years I lived outside India. The list does not include any electrical / electronic items. I'm thinking of sending the items under transfer of residence. Do I have to be present in India to receive these items when they arrive there? I've tried looking in various sites related to transfer of residence but am unable to find an appropriate response. Thanks, Padmini Answer: There are prescribed limits within which items can be shipped by those intending to avail transfer of residence concessions on customs duty in India. 1. You can ship the items you want to take to India within two months before your arrival date or 2. One month after your arrival Your presence will indeed be required in India at some point of time. When a person claims transfer of residence, there are some rules and declarations that must be adhered to. For instance: Customs Officer must ensure that you meet the required conditions for availing customs duty benefits under transfer of residence rules which require: o A minimum stay abroad of two years preceding the date of arrival in India on transfer of residence. o Person claiming such concessions has not availed transfer of residence benefit in the preceding three years o Declaration that no one else in your family has or will be availing transfer of residence benefit (three year period) Your presence in India will also be required at the time of customs clearance. If you are late getting there, your shipment may be held and you may have to pay all demurrage charges (fee charged by carrier for storage of goods). Your passport will also be endorsed to show the date you have availed transfer of residence. Generally all household items that have been in your possession for more than one year may be allowed duty free. Some items such as spices or liquor are not allowed duty free under transfer of residence. The shipping company you select to ship your goods should be able to provide you with complete details.
