Thank you for offering this website. I find your website really informative. Would appreciate if you could kindly reply back to my following queries relating to Power of Attorney. I took a joint loan (with my wife) from SBI and bought a flat in Bangalore. Now, the flat is ready for registration. But both of us (myself) are currently in Canada on a work permit. Hence we would like to give POA to my younger brother who stays in hyderabad. Q1. Is there a particular POA format that is acceptable to both SBI (for execution of my SBI documents) and Registration office for flat registration?. Q2. Can the POA be executed on a normal plan paper or there are stamp papers here in Canada as well (similar to what we have in India) Q3. Do I need to carry my brothers (i.e POA's) passport size photgraph while visiting Indian Embassy in Toronto for attestation?. If yes, how many?. Q4. As my flat is located in Bangalore but my brother is in hyderabad, is there any additonal documentation that needs to be provided along with POA? Q5. What all documents do we need to carry while going to Indian Embassy in Toronto? Q6. Can the same POA be used by my brother for flat registration as well as completing any other formalities from SBI side? Thanks you KP Answer: Thank you for your kind words regarding this website. Regarding your questions: I am not aware of any special power of attorney format that is exclusively required by The State Bank of India (SBI) or Sub Registrars in India. Any Power of Attorney duly attested by the Indian Consulate abroad should be acceptable. When a Power of Attorney is executed in India, a non-judicial stamp paper is normally used. The value of the stamp paper is as per prevalent rates set by the state government in India where the POA is executed. Normally this is about Rupees 100 in most states. However, since such stamp papers are not available abroad, Power of Attorney document’s are typed on a plain sheet of paper.

When executing a POA abroad.

o Type Power of Attorney on a plain sheet of white paper. o Where ever there are blanks shown that are filled in, they should be initialed o Each page of Power of Attorney document should be signed o The signature of the person who is giving Power of Attorney should be attested by an authorized official of the Indian Embassy/Consulate. This will involve going to the Indian Consulate with acceptable ID such as your Indian Passport and signing in front of the consulate official. However, I don’t recommend this to anyone. Always give a power of attorney to do a specific task on your behalf and have a validity time frame for the POA. Documents required by Indian consulates are normally: o Document to be attested in original with one photocopy. o Valid Passport and PR/Study Permit/Work Permit, as applicable, with a photocopy o Fee as applicable, payable to the Consulate General of India, (City where located i.e Toronto) by a bank draft/Money Order or by certified cheque.
