Q.1165 NOT Eligible for OCI DESPITE having proof of Indian Origin . . .

Question: Dear Mr Chand, I'm a German national having a German mother and an Indian father who deceased in 2015. In August 2017, I applied for an OCI card supplying all the necessary documents required as shown on the Indian Embassy's website. Indo-German-Consultancy-Services Frankfurt which processes the applications in Germany told me that my parents' marriage certificate was missing. As my parents have never been married, I cannot provide the certificate. The information on eligibility for an OCI card given by the Indian Embassy in Berlin states that I simply have to provide sufficient evidence for my Indian origin. Thus, I submitted a certified copy of the acknowledgement of paternity signed by by father as well as a copy of my birth certificate showing both my parents' names and, of course, a copy of my father's latest passport. So far, the application has not been declined or approved either. It appears to be suspended due to this special case since September 2017. Some information on the internet states that foreign born children of a foreign parent and an Indian parent who has deceased are not eligible. My question to you is, whether there is any chance to be granted an OCI card on the basis of my personal background and the documents I submitted or whether I'm not eligible for an OCI card due to the information I found as mentioned above. However, based on the current eligibility criteria for OCI you are not eligible for OCI. As per current rules, foreign born children where one parent is a foreigner and the other Indian parent has deceased are not eligible for OCI. There are many categories where people despite proof of Indian origin are not eligible for OCI. Take the example of a person working as a police officer in a foreign country, they are not eligible for OCI. Even their children are not eligible!
