Q.1253 Foreign national can inherit agricultural land in India
Question: Dear Sir,
I read lot of information about NRI buying agri land in India on your page. Still I am not sure whether I have
interpreted it correctly or not.
So I want to question specific to my situation.
I am India born EU national with holding OCI.
Recently my father bought agri. Land in India. (with the money I sent to him)
Is it possible that I can inherit this property? Or being foreign national I am not allowed to inherit this land?

Answer: Foreign national can inherit agricultural land in India. The fact that you sent the money to your father
should not matter. If your father used the money to buy agricultural land in a legal manner then you may be able to
inherit this land if your father wants you to get it.
Remember there is a difference between inherit and gift. Your father cannot gift this agricultural land to you due to
your foreign citizenship.
In such a case transfer by gift is not allowed. Acquiring by way of inheritance should be allowed.
