Q649. Farm land ownership dispute in India | Inheriting farmland in India
Question: Hi
I am oci holder my father was indian citizen he purchase farm land with my brother in law in 1990 after he purchase 2nd farm
land in 1993 with my brother in law name.
after 1994 they both saparted their land and my father was only owner of 1990 purchase land and my brother in law is owner of
1993 land
now 2013 my father died and made will to my name my brother in law didn't like it now he want to claim this land from me he
said your father was not farmer and I was farmer because of me your farther brought land do'snt matter who paid money
what should I do in this matter please advice me

Answer: Your question is not quite clear as to whether your father’s name was on the property as joint owner or were the
properties bought by your father only in your brother in laws name?
If your father’s name is shown on any of the property ownership documents, you should not be denied your inheritance as per
your father’s will. The fact that the property was jointly bought, by your father and brother in law and your brother in law now
claiming ownership to the property after your father’s demise on the basis of your father not being a farmer, is a flimsy attempt
to deny you your inheritance. The only advice I can give you is to consult a lawyer.
