168. Domestic violence case against NRI in India
Q: Hello Sir/Madam,
I m Canadian citizen but born in India with OCI holder. i have some legal questions about my marriage. i went to India and got
married in Jan-2010. i have a 8 year daughter from my previous marriage (my wife deceased in 2003). my new wife stayed
with me at my parents home in India for 20 days. and after i left to Canada she also left and staying with her parent's house.
now she filed a DV(domestic violence) case
against me, my father and my sister who lives with my father. my mother is in Canada with me and my daughter.
I have question on what is the legal consequences of OCI card holder. can Canadian consulate consider or entertain fake DV
case? is there anyway my wife can ask Canadian consulate to issue or file a case against me in Canada? She is demanding for
INR 35.00 lakh and separate apartment to live. Please advice me on this. i really appreciate your help.

A. I doubt if the Canadian government would force you to leave Canada on such a charge. Misuse of domestic violence charges
in India by women is becoming widely known as many NRIs have suffered due to this.
If you can prove that your wife is demanding 35 lakh and a separate apartment etc it may help your case if and when it comes
up in court. To give yourself peace of mind, consult with a lawyer.
