246. Reapply for US Visa from India

Q. Hello sir, Please answer my question, and I shall be much thankful to you: I am a US citizen (with Indian origin) residing in the US. One of my relatives and my sister wants to visit US, just for touring purposes. Is there any special time, they should apply for a visa because their visa has been already denied once. I would assume that they were refused under section 214(b) because those who are refused under section 221g are normally given a list of documents that they should submit for visa application to be re-considered. Refusal under section 214(b) usually means that your relatives were not able to convince the visa officer that they are genuine tourists. The visa officer may suspect that they might not leave the US and stay/work there illegally. They should not re-apply unless there is a significant change in the information they provided in their previous application or facts that they did not present during the first interview. Basically they should be able to convince the visa officer that: 1. They are financially sound and can well afford a trip to the United States. 2. They intend to return to India after their visit to the United States. To show an intent to return, one needs to show ties to India that would compel them to return, such as stable job, property, family etc. I am only mentioning some of these as examples. Each applicant has different circumstances and most importantly, the visa officer should be convinced of what you tell him. Help to relatives in India seeking a US visa can be provided by US residents to some extent. For example sometimes guarantee of sending a return flight ticket and assurance of taking care of all expenses while in the United States may help applicants who may be considered not financially stable enough to afford a trip to USA. While there is no restriction on when and how many times they can apply, each new application will require repayment of fee. Every rejection may make it more difficult for future visa application.
