254. How to get back Indian Citizenship
Q: Hi,
1 Now i am Canadian citizen but i want to go back to India and i want again Indian citizenship. for that what to do? and how long gov of India
taking time to give me my citizen back?
2 my all family member are Canadian citizen. i have farm(agricultural land). i want to transfer to my family member, can i do that? it is simple or
we require some premition from government?

A. You can acquire Indian citizenship by registration. An application from a person of Indian origin for registration as a citizen of
India under clause (a) of sub-section (1) of section 5 is made using Form II; There is a requirement that the applicant:
1.
Gives an undertaking in writing that he shall renounce the citizenship of his country in the event of his application being
sanctioned;
2.
Is ordinarily resident in India for a period of at least seven years on the date of making application; and
3.
Takes the oath of allegiance as specified in the Second Schedule to the Citizenship Act, 1955.
Regards to your second question, you can transfer agricultural land you legally own in India, only to a person resident in India
who is a citizen of India. If you want to transfer to a relative who is a Canadian citizen, you should get prior approval from
Reserve Bank of India (RBI) so as to avoid problems.
