379. Child custody right - having British Citizenship

Question: Hello, Currently me, my husband and my daughter all have a British citizenship with an OCI. My daughter was born in India thus her citizenship acquiring process was similar like ours. Could you please help me understand that in a scenario where if something happens to both me and my husband, will there be an issue for either of our parents or siblings (who have Indian citizenship) to claim her custody? Also, all our funds and property could provide sufficient funds but how exactly can we make sure that her guardian and she can have an access to it? Regards Nidhi Answer: In case your concern is that your daughter's British citizenship will prevent your parents from taking her back to India; in the scenario you mention in your email, you need not worry. To put your mind at ease, I strongly suggest that you consult a lawyer in UK. Both your husband and you, should make a will and each parent should designate the same guardian in a respective will to avoid problems of custody battles, your lawyer should be able to explain everything to you. I am not sure, how old your daughter is, once she reaches the age of majority, she can live wherever she wants to. There are many options to ensure, that money goes to the person you want to give it to. There are trust funds or annuities that can be setup to provide for example, a monthly income. A lawyer and accountant is what you need to help set up your legal and financial matters so as to ensure that your daughter is looked after in case the unexpected happens. UK also has a will registration service where wills can be registered. UK Will Register records the location of the Will, they do not ask for or keep a copy of the will. I believe they charge a one time fee of only £15. Their website is http://www.uk-will- register.co.uk/whyregister
