496. When must NRI file tax in India . . . How to change your address on PAN Card

Questions: Dear Sir, Your site is found very informative. I am NON Resident Indian and reside in Oman for over 30 years. As any one I have income generated in India by way of Investments in Fixed deposits, NRO and NRE by investing in Bonds/Shares/Mutual funds etc. The TDS on the such income is deducted every year and I have never claimed any refund for this TDS. 1) Do I need to file return of income in my case? 2) In my PAN card the address is Indian. In case I want to change my address to overseas how can I change. As some times IT department has sent letter to me for not filing the return of Income on my PAN address where I hardly reside for a week in a year. Please advice suitably. Thanks and regards, Purecha A Answer: If your taxable income is derived from only of investment income such as interest income from NRO/NRE bank accounts, capital gains income and tax has already been deducted at source (TDS)from all such income, you may not have to file income tax return in India*. For the year 2011-2012, generally NRIs must file a tax return if: 1. Their taxable income in India during the financial year was more than the basic exemption allowed, which is currently Rupees 1,80,000/- 2. *NRIs do not have an option for tax free Short Term Capital Gains on Equity Funds that is available to resident Indians who have income that is not in excess of the basic exemption. NRIs have to pay 15% tax on Short Term Capital Gains on Equity Funds even if their income is below the basic exemption. How to change your address on your PAN Card 1. Go to https://tin.tin.nsdl.com/pan/index.html 2. Select - Changes or Correction in PAN details 3. Select - Online Application for Changes Or Correction in PAN Data (PAN Change Request Form) 4. You will see the Guidelines page to fill in the form. Scroll down to the bottom of the page where it says: Apply for New PAN Card Or / And Changes Or Correction in PAN Data. Select Individual from the drop down menu and click select to view the application form to make changes to your PAN card. 5. Fill in the required information on the form. For changes or correction in your PAN data, tick box on the left margin of appropriate row where change/correction is required.
