Q630. ILR Visa holder leaving UK for 3 years - take 5 year old car to India

Question: Dear Sir/ Madam,

I am an Indian citizen, on the ILR visa in UK from last 3 yrs, now need to go back to India for 3 yrs training but would like to come back to UK to live. My querry is:- 1) Should i take the transfer of residence to India and take my car ( i do not have any house or family in UK) or should I just send my stuff with normal cargo and pay the import duty in india & do not opt for transfer of residence? 2) will there be any problem to come back after 3 yrs on ILR visa or do i need to start the whole process of visa again ( keep in mind that UK has stopped giving any more working visa)? 3) Will taking a second hand car be a good idea as it is 5 yrs old and how much duty I need to pay on this? 4) Can I come back to UK after taking transfer of residence to India and if so than after how many years? Whether you should take advantage of transfer of residence (TR). Even if you don’t take your car but have dutiable goods, you could avail duty concession through TR. The only thing to keep in mind is that once you avail the customs duty concessions in India through transfer of residency (TR) you will not be able to avail this TR benefit again for at least three years. 2. Generally, those who have Indefinite Leave To Remain (ILR) may lose it if they spend more than two years out of UK. So you may have to reapply and go through the process again. 3. Whether it’s a good idea to take a car to India if your intent is to stay in India for three years and return to UK, is something you must decide for yourself based on your priorities. There used to be a rule where those taking transfer of residency to India had to stay in India for a minimum of one year, this rule has been abolished.
