Question: Esteemed sir, I was 4 months old when I came to India, due to disputes with my father. My visa has expired 9 years back and my passport is invalid since my dad refused to sign in the passport. Now I am 15 years old staying with mom. What are the penalty or imprisonment going to be faced by me while leaving india? Thank you, ******** Answer: Penalties for overstaying visa validity generally depend on how the concerned authorities assess each case after reviewing all the relevant facts. I doubt if India would jail a 15 year old for a visa violation under the conditions that you mention. Since I am not privy to the facts of your case I cannot comment on it other than to say that when you leave India, you would require a valid passport and an exit visa. Speak to your mother and ask her to seek guidance from a trusted professional. Perhaps she should consider approaching the embassy/consulate of which you are a citizen for help in sorting this matter out. To get a passport, your mother will eventually have to contact the consulate of the country of which you hold citizenship. The local FRRO can provide information on exit visa.
