Question: Dears Sirs, Both my wife and I are Indian nationals and Indian passport holders living in Canada as PR card holders. All our children were born in Canada now adults above 18 years. I understand,by decent, that they were eligible for Indian citizenship at birth. Could you please refer me the legislation where it states that foreign born children in my case born in Canada, holding canadian passports can apply on their own for OCI. I am having some difficulty in locating/understanding this particular section in the Amended Indian Citizenship Act and OCI information. Some OCI information states that at least one parent must be an OCI in order to be eligible. Thanking you fonse. Dear Sirs, Following statement appears on BLS International Canada website. Can you please comment on this when considering the reply to my query. "In case applicants applying for OCI based on parents Indian origins. Then, one of the parents needs to be an foriegn National in order to be eligble for OCI" Thank you. Answer I don’t want to comment on what someone else has on their website. When I look at the quote you sent, the spelling of the words foreign and eligible is wrong! Some websites perhaps may have outdated information or have probably not yet updated to the latest information. Prior to January 6, 2015 the rules stated that at least one parent had to be a foreign national for a minor to apply for OCI. Now minor children where both parents are Indian citizens can apply for OCI.
