Q.877 Document attestation for housing loan in India

Hi, i've applied for a housing loan in India to buy an appartment in Bangalore and the banks request and attestation of my KYC and POA by a notary public or indian embassy. i prefer to get this done by a JP, would this be good enough? Where could i find the banking guidelines regarding attestaion procedure or authorities (Axis Bank) or RBI guidelines? thanks Bernard [April 30, 2016] Answer: The easiest way to deal with such matters is to ask your bank as to what type and format they require the Power of Attorney (POA) document to be in. Each bank will have their own set of rules so it is best to inquire from the source. Ask your bank to send you a sample document, link or copy of their guidelines. NRIs should ensure that regardless of who attests their documents, they get the Indian consulate in their area to also attest the document to give it force in India. The seal of the Indian consulate on attested documents will be widely recognized and accepted in India. One a power of attorney is attested, the POA should be registered in India. Attestation of a power of attorney document and registration of power of attorney document are two different things. In India any power of attorney document related to property that is not registered may not be acceptable in many cases and in case of disputes where an unregistered power of attorney is questioned, courts may not give such a POA any validity. Hence registration of POA is very important. Once a POA is drafted, it should be attested [by Indian consulate for NRIs] Then the POA should be registered in India in a timely manner.
