Q.938 Registration of Power of Attorney in India by US Citizen
Question: Sir
1. I am a great fan of your site and has perused same numerous times. I have a query for which I seek your valued
answer.
2. My son is a U S citizen having PIO card. He is visiting India shortly. He had earlier - 7 years ago given me a GPOA
but it seems the same has to be adjudicated before a Sub Registrar.
3. Instead of getting it notarized and attested at the Indian Embassy could he use his trip to India to present himself
along with me in front of the Sub Registrar and execute the document?
4. My question is he being not a citizen of India - does it matter?

Answer: Not being a Citizen of India should not matter. Both of you will need to provide two passport size
photographs and show acceptable Identity proof when you appear before the Sub Registrar.
If you use the services of a lawyer they will also act as witness in the Sub Registrar’s office and save you from
waiting most of the day at the office when you go for registration.

Q: Very many thanks for your very prompt reply. Alas I wish all our countrymen especially in the Govt sector is as
prompt in replying to emails they receive as you are ! One corollary to my question. I presume that the GPOA has to
be typed in Indian Stamp paper since it is being executed in India. Am I correct?

A: Yes stamp paper is required. As mentioned earlier it's best to let a lawyer draft power of attorney document.
