Q.946 Divorce certificate attest from Ministry of External Affairs for OCI

Question: Hi Mr. Chand, You are our last hope now. My friend applied for OCI card but she has a problem. She was divorced in Canada 17 years ago when she and he husband both were Canadian citizen. She has Divorce certificate from Canadian government but OCI official is asking for divorce paper from India. Please advise and Thank you, Deepa Answer: Regarding your email, my understanding is that if marriage has taken place in India and divorce certificate is issued by foreign court, then the divorce certificate needs to be attested by Ministry of External Affairs, New Delhi. The way to get Ministry of External Affairs (MEA) attestation by those who are abroad is to first get the document attested by the Indian Consulate in their area of residence. Then send the document to India for attestation by MEA. This can be done by either sending document to a family member or to use an attestation service provider. There are many such companies. They charge a fee for their services such as getting attestation done on documents and courier them back. There are many such attestation provider companies in India. Some may claim to be approved by the Ministry of External Affairs (MEA) however keep in mind that they are not working for MEA and are private businesses providing a service for a fee. They just act on your behalf and cannot exercise any undue influence on the MEA. Basically you send your documents to them, they present it to the Ministry of External Affairs for attestation on your behalf, if documents are valid/authentic and attested by the Indian Consulate, the MEA will also attest the document. The Service providers will then courier the documents back for a set fee covering their services and courier costs. I don’t want to recommend any particular company providing such services and people can select to deal with whoever they feel comfortable with.
