Q.1041 Indian citizenship for Nepalese citizens
Question: Respected sir,
I was born in nepal my father since his childhood was was living here.He migrated to nepal with my grandfather to earn
living in nepal. Recently he owns a small business in nepal.
He had many sports certificates of judo under nepali government of his childhood age.
In last decade he was unable to fill application as on "TOLI"where nepali citizenship was entitled.
Sir is there any way to get the citizenship now..?
I was born here studied here sang national anthem for over 18 years....so y cant i be called nepali.... Opportunities are
why not available to me .
I have a birthcertificate too .
Suggest me a way if permittable to obtain nepali citizenship.

Answer: There are currently no special provisions that I am aware of for Nepalese citizens to claim Indian citizenship.
Here is some general information on Indian citizenship that you can see and decide if any of this applies to your
situation.
A person can have a claim to Indian citizenship in the following circumstances:
Born in India:
•
A person born in India on or after 26th January 1950 but before 1st July, 1987 is citizen of India by birth irrespective
of the nationality of his parents.
•
A person born in India on or after 1st July,1987 but before 3rd December, 2004 is considered citizen of India by
birth if either of his parents is a citizen of India at the time of his birth.
•
A person born in India on or after 3rd December, 2004 is considered citizen of India by birth if both the parents are
citizens of India or one of the parents is a citizen of India and the other is not an illegal migrant at the time of his
birth.
Indian citizenship by Descent
•
A person born outside India on or after 26th January 1950 but before 10th December 1992 is a citizen of India by
descent, if his father was a citizen of India by birth at the time of his birth. In case the father was a citizen of India
by descent only, that person shall not be a citizen of India, unless his birth is registered at an Indian Consulate
within one year from the date of birth or with the permission of the Central Government, after the expiry of the
said period.
•
A person born outside India on or after 10th December 1992 but before 3rd December, 2004, is considered as a
citizen of India if either of his parents was a citizen of India by birth at the time of his birth. In case either of the
parents was a citizen of India by descent, that person shall not be a citizen of India, unless his birth is registered at
an Indian Consulate within one year from the date of birth or with the permission of the Central Government, after
the expiry of the said period.
•
A person born outside India on or after 3rd December, 2004 shall not be a citizen of India, unless the parents
declare that the minor does not hold passport of another country and his birth is registered at an Indian consulate
within one year of the date of birth or with the permission of the Central Government, after the expiry of the said
period.
By Registration
•
A person who is married to a citizen of India and is ordinarily resident in India for seven years before making an
application for registration may apply.
By Naturalization
•
A foreigner who has resided in India for twelve years may naturalize as an Indian citizen. The applicant in this case,
must have lived a total of 12 years in India in a period of 14 years, and must have lived in India for 12 months
continuously prior to applying for citizenship.
