Could you please help me with the below query ?
I am an Australian citizen with an OCI and my wife is an Indian national and we are currently staying in India.
When our kid is born in India, can he/she choose the Indian citizenship since one of his/her parent is an Indian.
I appreciate if you can clarify my query.

Answer: Yes! As per The Citizenship Act, 1955. [(1) By Birth (Section 3)]
‘A person born in India on or after 3rd December, 2004 is considered citizen of India by birth if both the parents are
citizens of India or one of the parents is a citizen of India and the other is not an illegal migrant at the time of his birth.’
If your wife is an Indian citizen then this would make your Indian born child eligible for Indian citizenship. However, do be
aware that you will not be able to get dual citizenship for your newborn child. India does NOT allow dual citizenship.
