Question: Hello, I googled “penalty overstay visa in India” and your page was the first result that appeared. I just wanted to let you know that the information is now out of date. I recently overstayed my visa in India and the penalty/exit visa at the airport is now $300. I wasn’t able to find this information on any websites so I’m letting you know in case you’d like to update your info to help other travellers! Many thanks! Answer: If you recently paid $300 at the airport as penalty for overstay of your visa, did you get a receipt? Penalties for overstay of visa in India as per my understanding of the rules depend on: Length of overstay Reason of overstay Readers should not treat overstay of visa lightly and expect to simply pay a fine and get away. Each overstay case is considered by the authorities taking into consideration the reasons of overstay. Penalties in addition to fines can also sometimes result in prosecution under Foreigners Act 1946 and imprisonment up to 5 years with fine & expulsion from India. While I appreciate your email to help other travelers, I cannot correct the information already provided on Nri Information website unless an official announcement is made by the government authorities. Sort overstay issue before heading for the airport Anyone who has overstayed their visa should sort their visa overstay issue before heading to the airport. In case overstay of visa is discovered at the airport, then you may not have an option of simply paying a fine but may now be allowed to leave India.
