5. Can born in Pakistan spouse of
OCI holder get PIO card
Question: First of all, it’s a great website. Loads of
information concerning NRIs and facilities available to
them is very helpful.
Kindly please assist with the following question:
Is the wife of a foreign passport holder (husband is eligible
for OCI and PIO) can apply to become PIO? The wife was
born in Pakistan but is not a Pakistani citizen and is a
foreign passport holder. Will appreciate your answer to
above query.
Regards
N. Sehgal
Answer: The country of birth is what is normally
considered.
Even though your wife is currently not a Pakistani citizen
currently, the fact that her place of birth is Pakistan and
she may have been a Pakistani citizen before acquiring
foreign citizenship would disqualify her from being eligible
of PIO card.
The rule for eligibility for a PIO card, disqualifies anyone
who was at any time a citizen of Afghanistan, Bhutan,
China, Nepal, Pakistan and Sri Lanka.
You could of course confirm with the Indian consulate.
