329. Can Green Card holder continue to work for Government of India?
Q: Hi,
My name is Indira. I am working in India in Ministry of Textiles. I obtained greencard in U.S.A through follow to join option of my husbands
green card status. My children are studying in U.S.A since 2 years meanwhile I visited U.S.A twice by using leave at my credit. meanwhile my
office rised a question regarding my visit abroad to vigilance that being a green card holder of U.S.A can I work in Government office in India
or my stay in this office is illegal.
Kindly clarify me please. MY contention in this regard is I am still a Indian citizen though I got the eligibility of residency in U.S.A though some
means so I can work in my office, if at all something is going to happen , it is the U.S. Immigration to think whether my green card is to be
continued or not, please tell me whether I am right or my office is right. If at all I am right, please give me some link to Rule position which
supports my stay
here.

A. The way I see your situation, you got a green card based on the 'Following to Join Spouse' category. While I understand that
the route you took to get a green card was the fastest way to get it, others may perhaps not be able to fully understand your
actions. Some may question why you opted for a green card instead of getting a tourist visa to visit your husband if you had
no intention of living in the United States.
I am not sure what the official policy is of your work place, your only option is to try and convince them that you never had
any intention of moving to the United States and got a green card as a matter of convenience only. Although, since your
children are also in the United States it is going to be hard to convince your employers.
My suggestion to you is that you should approach your superiors and clarify your situation. There are no rules that I can give
you a link to that will help you. Since you work for the government, whatever the official rules are at your workplace, will
apply.
