354. Indian origin spouse cannot help foreign spouse with OCI

Q: Hi, I am an Indian living in the UK at the moment. I am intending to get married to a white British National. After our marriage I ll be applying for the British Citizenship and once I ve had my British citizenship I am intending to apply for my OCI. Now my question is as my wife is married to a person of indian orgin will she also be eligible for OCI? In addition will our children become automatically eligible for OCI? Please advise me on this matter. Thank you. Sam Ellis A. Regarding your questions: Your wife will not be eligible to apply for OCI on the basis of her being married to a person of Indian origin. She could however, apply for a PIO Card. Your children will be able to apply for OCI. UPDATE Foreign spouse may now be able to apply as effective January 06, 2015 rules changed.
