410. OCI application rejected - Appealing to High Court in India?

Questions: I was rejected OCI couple of times,one by Consulate General of India,Chicago. Second one directly to MHA through hiring Lawyer in Delhi. Now my lawyer is working on taking the matter to High Court but still working on writ and taking forever. i already paid his fees,any advice please what to do. thank you Tenzin Jangchup Answer: If a rejection has been made at the Consulate, the chances of success by applying directly in India are rare. While PIO applications may be decided at the Consulate level, OCI decisions are made in Delhi. What is important is the reason for the rejection. Lawyers will always paint a rosy picture to get clients to take cases to court. They get paid for their services, regardless of the outcome of the case. I cannot comment on the outcome of your case as I am not aware of the reasons for your OCI rejection, all I can say is that you are facing an uphill task. Once your lawyer prepares a writ, the court may take time to decide when and if to hear the case! My suggestion to those who are unable to get OCI, would be to opt for a PIO card. The major difference in the two are basically, a visa for life versus a visa for 15 years. PIO card holders can also apply for Indian citizenship after residing in India for seven years.
