Question: Hi I am bala from malaysian.

I am indian and having malaysian citizen . Come to india with tourist visa .

Now I over stay nearly 8 month. Now I want to go back to malaysia .

What should I do. Pls help. Now I stay in banglore.

Answer: Overstaying in India beyond your Visa validity period should not be taken lightly. On a serious note, foreigners who overstay could face not only a fine but also imprisonment in India. Of course each case would be evaluated by the authorities depending on the circumstances behind the overstay. Under current rules, overstaying your visa in India by a foreigner can result in prosecution under the Foreigners Act 1946. Penalty can be imprisonment of up to five years and expulsion from India. A word of caution though! rules and regulations do change from time to time. Only the FRRO offices or the Ministry of Home Affairs, Foreign Division at Jaisalmer House, 26 Man Singh Road in New Delhi is the authority to provide current information on such matters.
