Q.1052 Aadhaar Requirement for PIOs
Question: Sir
These are the facts to be noted:
1. My son in law is a U S citizen living in USA
2. He has landed properties and MF investments in India which are managed by me as his POA
3. I filed the current years I T R without having to mention AADHAR by quoting his PAN
4. However in case AADHAR is needed henceforth some doubts arise as to how to get same.
5. Following are needed for getting aadhar as per your site: 1. Proof of Identity 2. Proof of Address & 3. Proof of Date of
birth
6. While PAN is considered enough for item 1, I do not know whether his U S Passport which is mentioned as a document
could be submitted since it has his U S address.
7. My question is whether the address has to be of a place in India? This is not clear! Or is it OK to give the address as in
USA?
8. It says “The provisions of this section shall not apply to such person or class or classes of persons or any State or part of
any State, as may be notified by the Central Government in this behalf, in the Official Gazette.”
9. Any idea if any such notifications have been made to exclude PIOs residing in foreign countries?
A reply would be greatly appreciated. In the past your site is the only one which is dependable and which I have been
using.

Answer: Regarding your questions:

For Aadhaar proof of address in India will be required. Furthermore applicant must be present in India to complete
the biometric data requirement at a Aadhaar Enrollment Center.

Non-Residents, PIOs living abroad who do not have Aadhaar can file Indian taxes without furnishing Aadhaar as they
are exempt. Linking of PAN & Aadhaar is compulsory only for those who are eligible for Aadhaar. As a foreign
resident your son would be exempt.

US passports I believe do not show the passport holders address. Many countries passports do not show the
residential address of the passport holder and some simply have space provided for the passport holder to fill in
their own address. This would not be deemed by authorities as official address of the passport holder, although it
does show proof of identity.
