Q.1070 Can US citizen being of Indian origin get PAN Card

Question: Hi Mr. VK Chand, I have an issue and wanted to know if you know how to solve this or any recommendation: • My Wife is not of Indian Origin and US Citizen: o Can I get a PAN Card for her? This is because she jointly owns a property with me in Kolkata (I am an NRI and and have PAN Card) and in the process of selling this property I am hearing from the buyers that this property can be registered in their name because my wife does not have a PAN Card and is not an NRI?  Is there another way I can get around this problem? Can she gift this property to me and what is the process for this and will this be accepted by the Registrar Office in Kolkata during registering to the new owner? I will really appreciate any help you can provide on this? With Thanks and Regards, [Due to requests from several individuals who have emailed questions to our NRI Question & Answer section to not publish their names, the practice of publishing senders name is being discontinued.] Answer: I assume the buyers are saying the property cannot be registered in their name due to your wife as joint owner not having a PAN. Even though your wife is not of Indian Origin, she can apply for a PAN card. Foreign citizens who wish to apply for a PAN need to provide the relevant documents similar to what Indian citizens provide, such as ID proof and proof of address. Fee for foreign PAN applications from abroad is currently Rs. 1020. The higher fee is due to additional mailing costs involved. Foreigners can apply online for a PAN Card from abroad. To apply online for a PAN Card: 1. Visit: https://www.onlineservices.nsdl.com/paam/endUserRegisterContact.html 2. If applying for a new PAN then Select Application Type as New PAN - Foreign Citizen (Form 49AA) 3. Select Category as Individual 4. Follow the prompts and fill in the required information as indicated on the form and submit.
