Q.1198 Overstay in India beyond tourist visa validity – Exit Permit . . .
Question: Hi,
I have question regarding indian tourist visa.i.e.,
My son born in USA and got his passport from USA, and he got india tourist visa (multiple entries).
and,
1) if he wants to stay in india for more than 6months, what could be the procedure, would it be a problem in future for
him bcoz of over stay in india.
2) is there any online website to get exit visa.
3) in case of any restrictions on over stay in india beyond 6months, would it be the same procedure to get exit visa if he
stays in india for 1year or 2years in india on visiting visa?.
please help me to get these details.

Answer: Tourist visas for India generally have a validity of six months however US citizens can by virtue of a bilateral
agreement can also get a five or ten year tourist visa.
Keep in mind that regardless of the duration validity of a tourist visa, the maximum stay allowed in India per visit is
limited to six months. Those who wish to stay in India for a period longer than six months per visit should apply for the
appropriate long term visa.
Visa validity of Indian visas start from the day they are issued and NOT from the date of arrival in India. Those planning
to stay up to six months [180 days] should keep this in mind.
Anyone already in India on a tourist visa and intending to stay beyond the six month period should contact the nearest
FRRO office to request a visa extension preferably before the expiry of their visa. Overstay beyond visa validity should
not be taken lightly and may lead to problems. Reasons and length of overstay are taken into account by the authorities
when deciding on penalties for overstay of visa.
Short term overstays can generally be handled by paying a fine at the FRRO but for longer overstays the home ministry
may be the one who will give authorization for allowing exit visa and accessing the appropriate penalties.
