Q.1197 Power of Attorney from UK NRI to NRI . . .

Question: Dear Sir, Greetings, I hope you can help me with my below question. We (I and my wife) are UK residence (NRI) and have a property in Gazhiabad (Uttar Pradesh) on joint name. We would like to sell this property but my wife can not travel and so can she provide the power of attorney from UK consulate and can I sell the property as her attorney in India. OR the Attorney must be a Indian residence? If I can execute the PoA then where to get the power of attorney registered? At the place where property is there UP or our permanent residence in MP? Your help will be appreciated. Warm Regards Answer: A power of attorney in your favor attested by Indian Consular Officer in UK and duly registered in India should be acceptable. There is no mandatory requirement that foreigners give POA only to a resident of India. Powers of Attorney executed abroad for use in India should be authenticated by an Indian Consulate official. It should be stamped or adjudicated, within three months after receipt in India.
